When is a rent increase inadmissible?
A rent increase is inadmissible if it exceeds the local comparable rent (Section 558(1) BGB), breaches the 20% cap (or 15% in tight markets) within 3 years (Section 558(3) BGB), or contains formal errors — such as missing justification by rent index or expert opinion (Section 558a BGB).
Do I have to agree to a rent increase?
